Rogelio Lara Succumbs to Injuries Caused by Pedestrian Crash in San Jose
San Jose, CA (April 20, 2022) – Rogelio Lara (74) died ten days after getting involved in a pedestrian accident in San Jose. According to the Mercury News, the crash happened at around 2:54 pm on Thursday (April 7).
According to reports, Lara crossed Quimby Road around Burdick Way. Then, a 2014 Hyundai sedan hit him. After the collision, they transported Lara to a local hospital for medical care. Lara’s injuries were reportedly non-fatal. However, he still died on April 17.
Initially, Rogelio Lara was expected to recover from his injuries, but he died later on.
According to authorities, the Hyundai’s driver remained at the scene. They didn’t believe that he was intoxicated ot impaired during the accident. Police also shared that Lara didn’t cross the street through a marked crosswalk. According to authorities, Quimby Road had no marked crosswalks within its half-mile stretch between ast Capitol Expressway and South White Road.
State law considers right-angle intersections of most streets as legal crosswalks. However, Quimby Road’s portion near Burdick Way is curved. According to the Mercury News, this information caused a review on Google maps to suggest installation of a marked crosswalk in Quimby Road and Burdick Way. The review stated that other pedestrians regularly travel through the area. They’re required to go through five lanes to reach bus stops only located on the other side of the street.
According to the Mercury News, this accident involving Lara is the city’s 27th roadway death of 2022, making it the deadliest year. This also goes above a 25-year peak of 60 deaths recorded last year and tied in 2015 as well as 2019. 2022’s total included 14 cases involving pedestrian fatalities.
This fast pace caused city authorities to promote stricter traffic regulations. This also prompted discussions of putting speed-recording cameras on the most dangerous routes and intersections.

More About Pedestrian Accident Liability
Pedestrians usually get major injuries in pedestrian accidents. Sometimes, they can even cause death. When it comes to liability, it can fall on the pedestrian or driver based on various factors of the accident. Proving liability can become vague or obvious. The process generally involves finding out who acted carelessly, causing the accident. Any Los Angeles personal injury or accident lawyer will tell you that you need to show the following to prove negligence and liability:
- legal responsibility or “duty of care”
- violated or breached the duty of care
- the violation caused the accident
- the violation resulted in injuries or damages
In some cases, the driver might’ve sped down the road, hitting the pedestrian. This can put fault on the driver. Meanwhile, pedestrians can also get hit by a car because they acted against traffic signals. In these instances, the pedestrian can become at fault. Other factors, such as lack of road markings and ample lighting, can also lead to pedestrian accidents. In these cases, a pedestrian accident lawyer can help look at all angles to determine liability. Learn more about pedestrian accident lawyers in California here.
